By creating an account, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Acceptance of Terms

By accessing or using Dena AI, you acknowledge that you:

  • Have read and understood these Terms

  • Agree to comply with them

  • Are legally capable of entering into binding agreements

If you are using Dena on behalf of a business, you confirm that you are authorized to bind that business to these Terms.

2. Service Description

Dena AI provides:

  • A cloud-based AI-powered phone system

  • Automated call handling, routing, and reception

  • Conversation transcription and analytics

  • Messaging, scheduling, and workflow automation tools

  • Integrations with third-party business software

The Service may evolve over time. Features may be added, modified, or removed at our discretion.

3. User Responsibilities

You agree to:

  • Provide accurate account and billing information

  • Use the Service only for lawful business purposes

  • Maintain the confidentiality of your login credentials

  • Ensure your use complies with all applicable regulations, including call recording laws

You are responsible for the activities that occur under your account.

Call Recording Compliance

You acknowledge that:

  • Call recording laws vary by jurisdiction

  • You are responsible for enabling proper consent prompts

  • Dena provides tools (e.g., custom greetings), but legal compliance is your responsibility

We are not liable for misuse or failure to comply with applicable laws.

4. Use License

We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Service for your business.

You may not:

  • Reverse engineer, decompile, or modify the software

  • Copy or resell any part of the Service

  • Use the Service to build a competing product

  • Interfere with system operations or security

  • Circumvent usage limits, plan restrictions, or authentication

  • Use the Service in any way that harms Dena or other users

Violation of these restrictions may result in immediate account termination.

5. Billing, Payment & Subscription Terms

Subscription Fees

  • Plans are billed monthly or annually in advance

  • Fees are non-refundable unless required by law

  • Overage charges (call minutes, messages, storage, etc.) may apply

Price Changes

We may adjust pricing with 30 days’ notice.

Payment Authorization

By subscribing, you authorize us to:

  • Charge your payment method automatically

  • Collect overdue balances using the payment method on file

Failed payments may lead to account suspension.

6. Free Trial

New customers may receive a 7-day free trial.

During the trial:

  • You may cancel anytime without charge

  • If you do not cancel, your subscription will begin automatically

Trials may be revoked in cases of abuse or misuse.

7. Account Termination

You may terminate your account:

We may suspend or terminate your account if:

  • You violate these Terms

  • You engage in fraudulent, abusive, or illegal activity

  • Your payments fail repeatedly

  • Your use threatens system stability or security

Upon termination:

  • Your access ends immediately

  • We may delete your data per our Privacy Policy

8. Availability and Service Performance

We strive for high uptime and reliability but do not guarantee:

  • Uninterrupted access

  • Error-free performance

  • Accuracy of AI-generated responses or analytics

  • Compatibility with all devices and networks

Some features, including transcription accuracy or call routing behavior, may depend on third-party systems (e.g., telecom providers).

9. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

We disclaim all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy or completeness of information

Use of the Service is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Dena AI is not liable for indirect, incidental, special, consequential, or punitive damages

  • This includes loss of revenue, profits, data, business, goodwill, or opportunity

  • Our total liability for any claim will not exceed the amount paid to us in the previous 3 months

Some jurisdictions do not allow certain limitations, so some exclusions may not apply to you.

11. Third-Party Services

Our Service may integrate with third-party software, carriers, or platforms.
We are not responsible for:

  • Their availability

  • Their actions or failures

  • Data handled once transmitted to them

Your use of third-party tools is governed by their terms.

12. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.

You agree to submit to the exclusive jurisdiction of the courts located in the United States.

13. Modifications to Terms

We may update these Terms periodically.
When changes are significant, we will notify you via:

  • Dashboard alerts

  • Website notice

Continued use of the Service after changes constitutes acceptance.
